Exclusive Design Policy

If a customer opts to pay the exclusive design fee, the design will be created and not listed on our website for sale. Cardinal Police Diecast will reserve the right to build personal models for the Cardinal Police Diecast members' collections or for demonstration of design, decal or application quality. Cardinal Police Diecast will also reserve the right to post images of the design or decals on Facebook or any other advertising method for the purpose of demonstrating design quality, print quality or decal quality. We also reserve the right to deny exclusivity requests. The decals will not be posted and advertised for public sale. We will wait up to 30 days before any form of advertisements including the custom designs will take place.
The customer requesting the exclusive design has the right to relinquish the exclusivity of the design at any time to allow for public sale. This will not result in a refund of the exclusive design fee. Customers that did not request an exclusive design with their custom design request have the right to pay for their exclusive design fee at any time and stop public sale of the decal design. Sales made for the design being made exclusive will still be fulfilled if in process while exclusivity is being requested.

Exclusivity rights can be released or transferred at any time with proper notification to Cardinal Police Diecast through any of our contact forms, email addresses or official social media accounts. Customers who ordered decals with an exclusive design fee have the right to release the exclusive design rights allowing Cardinal Police Diecast to publicly sell the design or designs that exclusivity rights were purchased. No refunds or any other payments or considerations will be made at the time for cancelling exclusivity rights.

Customers who ordered decals with an exclusive design fee have the right to add on additional people to have access and rights to purchase the decals. The original exclusivity rights owner has the right to cancel this access at any time. Cardinal Police Diecast will not facilitate or be responsible for any issues arising from a shared exclusive design. There will however be only one initial owner who will be the primary facilitator of the design. The primary facilitator has the right to add on additional shared owners, cancel/release exclusive design rights, transfer rights or remove shared owners.

Customers who ordered decals with an exclusive design fee have the right to transfer their initial ownership rights to another person. All rights described in this policy with therefore transfer to the new owner. The new owner, the recipient of the transfer of exclusivity rights, will be considered the new primary facilitator of rights.

Exclusivity rights will only be cancelled by Cardinal Police Diecast following death of the initial rights owner. Exclusivity rights are owned by individuals and not by businesses. These rights will not transfer to family members or business partners after death, unless proper notification to Cardinal Police Diecast through any of our contact forms, email addresses or official social media accounts of such intentions to transfer or add on additional owners of exclusivity rights. If additional owners are present at the time of death, primary facilitator rights will be transferred to them automatically.

Incomplete or unpaid orders that were requested as an exclusive design fee may be posted for public sale and advertised to show design quality, print quality, decal quality or for any other reason. If the customer returns to finish the order, a custom design fee and/or an exclusive design fee will still be charged to the original requesting customer as the design was created for the requesting customer. An exclusive design fee can also be added at any time and stop public sale of the decal design. Sales made for the design being made exclusive will still be fulfilled if in process while exclusivity is being requested.
